Welcome to ziatile.com! This Privacy Policy explains how Zia Ventures LLC, d/b/a Zia Tile (“Zia Tile,” “we,” “us,” or “our”) collects, uses, shares, and protects your personal information when you visit our website, create an account, place an order, apply for or participate in our Trade Program, sign up for marketing, contact customer service, or otherwise interact with us. It also describes the choices you have regarding your personal information and the privacy rights that may be available to you depending on where you live. Please read this Privacy Policy carefully. By using our Site and Services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our practices, please do not use our Site or Services.

Overview

This summary is for convenience only and does not replace the full Privacy Policy below, which governs in the event of any conflict.

  • We collect information you give us (name, contact and billing/shipping details, account credentials, order history, Trade Program business information) and information collected automatically (device, browser, and usage data through cookies and similar technologies).
  • We do not sell your personal information for money. We do work with advertising partners—which may include Meta (Facebook/Instagram), Google, Microsoft, StackAdapt, and OpenAI/ChatGPT—who use pixels and similar technology to show you personalized ads based on your activity on our site. Under some state privacy laws, this counts as "sharing" (and, in a few states, potentially a broader definition of "sale") of personal information, even though no money changes hands. You can opt out of this at any time—see Section 12.
  • We send marketing emails if you sign up or make a purchase, and you can unsubscribe at any time.
  • Our Trade Program offers exclusive pricing to qualifying trade professionals. Because enrollment involves an exchange of information for a pricing benefit, California law treats this as a "financial incentive," and we describe the material terms in Section 11.
  • Depending on where you live, you may have rights to access, correct, delete, or port your personal information, to opt out of targeted advertising, and to appeal a denied request. See Section 12 for details specific to your state or country.

1. Scope and Applicability

This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit ziatile.com or any other website that links to this Privacy Policy (collectively, the "Site"), create an account, place an order, apply for or participate in our Trade Program, contact customer service, or otherwise interact with us (collectively, the "Services"). This Privacy Policy does not apply to information collected offline or through any other website or service, except as otherwise stated.

This Privacy Policy should be read together with our Terms of Use and the disclosures in our Cookie Preferences tool.

2. Personal Information We Collect

We collect the following categories of personal information, depending on how you interact with us:

  • Identifiers. Name, email address, postal address, phone number, username, and unique online/device identifiers.
  • Account and Authentication Information. Password and account security information if you create an account.
  • Commercial Information. Products purchased, order history, payment method type (not full payment card numbers — see Section 7), returns, and communications with customer service.
  • Business and Professional Information. For Trade Program applicants and members: business name, resale certificate or contractor/design license information, business address and contact details, and other information reasonably needed to verify trade eligibility.
  • Internet or Other Electronic Network Activity Information. Browsing activity on our Site, pages viewed, links clicked, search terms, referring/exit pages, and interactions with our marketing emails, collected through cookies, pixels, and similar technologies (see Section 5).
  • Geolocation Information. Approximate location derived from your IP address or shipping address; we do not collect precise (device-level GPS) geolocation.
  • Inferences. Preferences and interests inferred from the categories above, used to personalize your shopping experience and the advertising you see.

We do not intentionally collect Social Security numbers, government ID numbers, precise geolocation, health information, biometric information, or other sensitive personal information, except that payment-related information may be considered sensitive personal information under some laws; see Section 7 regarding our payment processors.

3. Sources of Personal Information

We collect personal information:

  • Directly from you — when you create an account, place an order, apply for the Trade Program, sign up for marketing emails, contact customer service, or otherwise communicate with us.
  • Automatically — through cookies, pixels, and similar technologies when you use our Site (see Section 5).
  • From service providers acting on our behalf, such as our website hosting, e-commerce, and email platform providers.
  • From advertising partners, which may include Meta, Google, Microsoft, StackAdapt, Pinterest, and OpenAI/ChatGPT, who may provide us with aggregated or anonymized information about the performance of our advertising campaigns.

4. How We Use Personal Information

We use personal information to:

  • Create and maintain your account, and authenticate you when you log in;
  • Process, fulfill, and manage your orders, payments, shipping, returns, and exchanges;
  • Verify eligibility for, administer, and communicate with you about the Trade Program;
  • Respond to customer service inquiries and provide support;
  • Send transactional and account-related communications (e.g., order confirmations, shipping updates);
  • Send marketing emails, where permitted, and measure their effectiveness (see Section 9);
  • Personalize your experience on our Site and show you advertising, including through the advertising pixels described in Section 6;
  • Maintain the security, integrity, and proper functioning of our Services, and detect and prevent fraud;
  • Comply with applicable law, respond to legal process, and enforce our Terms of Use; and
  • With your consent, for other purposes disclosed to you at the time of collection.

5. Cookies, Pixels, and Similar Tracking Technologies

We and our service providers use cookies, web beacons, pixels, software development kits (SDKs), and similar technologies ("Cookies") to operate our Site, remember your preferences, understand how visitors use our Site, and deliver advertising.

We use the following general categories of Cookies:

  • Essential Cookies — these Cookies are necessary for the Site to function (e.g., shopping cart, checkout, account login, security);
  • Analytics/Performance Cookies — these Cookies help us understand how visitors interact with our Site so we can improve it;
  • Functional Cookies — these Cookies remember choices you make to provide a more personalized experience; and
  • Advertising Cookies — these Cookies, which may include pixels and similar technologies from partners such as Meta, Google, Pinterest, Microsoft, StackAdapt, and OpenAI/ChatGPT, are used to measure the effectiveness of our advertising and to show you more relevant ads on our Site and on third-party platforms (see Section 6).

You can manage your Cookie preferences at any time using the Cookie Preferences Tool, which allows you to view and adjust the categories of non-essential Cookies that are active on your device. Your Cookie preferences are also honored consistently with the opt-out rights described in Section 12, including Global Privacy Control and other recognized opt-out preference signals.

6. Online Advertising and Interest-Based Ads

We may work with third-party advertising partners, which may include Meta (Facebook/Instagram), Google, StackAdapt, and OpenAI/ChatGPT, who use pixels and similar tracking technologies placed on our Site to:

  • Understand how you interact with our Site after seeing one of our ads;
  • Measure the effectiveness of our advertising campaigns; and
  • Show you personalized (interest-based) ads for our products on their platforms and elsewhere, based on your activity on our Site and information those platforms independently hold about you.

These advertising partners may combine information collected through their pixels with other information they have about you from other sources, subject to their own privacy policies. We encourage you to review each advertising partner’s privacy policy (including those of Meta, Google, Pinterest, Microsoft, StackAdapt, and OpenAI/ChatGPT) to understand how they use this information.

Some of these advertising partners (for example, OpenAI/ChatGPT) may use artificial intelligence or machine-learning technologies to deliver, target, personalize, or measure the ads you see. We use these technologies only for advertising and analytics purposes and not to make automated decisions that produce legal or similarly significant effects about you. The specific partners and technologies we use may change from time to time.

7. How We Share Personal Information

We do not sell personal information to third parties in exchange for money. We may disclose personal information to the following categories of recipients, each acting under contractual obligations that limit their use of your information to the purposes for which we share it:

  • Payment Processors. We use third-party payment processors (such as Shopify Payments, Shop Pay, PayPal, Google Pay, and Venmo) to process payments. These processors receive and handle your payment card and payment account information directly; we do not store full payment card numbers.
  • Shipping and Logistics Providers. Carriers and freight companies to fulfill and deliver your orders.
  • IT, Hosting, and E-Commerce Platform Providers. Vendors who host our Site, manage our e-commerce platform, and support our order-management and customer-service systems.
  • Email and Marketing Platform Providers. Vendors who send marketing and transactional emails on our behalf.
  • Advertising Partners. Meta, Google, Microsoft, StackAdapt, OpenAI/ChatGPT, and similar advertising platforms, as described in Section 6.
  • Analytics Providers. Vendors who help us understand Site usage and improve our Services, including Google.
  • Professional Advisors. Attorneys, accountants, auditors, and insurers, as needed.
  • Government Authorities and Legal Proceedings. Where required by law, subpoena, or court order, or to protect our rights, property, or safety, or that of others.
  • Business Transfers. In connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of some or all of our assets.

8. Do We "Sell" or "Share" Personal Information?

We do not sell personal information in exchange for money. However, several state privacy laws—including California's—define "sale" broadly enough to include some non-monetary exchanges of personal information, and separately define "sharing" to include disclosing personal information to third parties (like advertising platforms) for cross-context behavioral advertising.

Our use of advertising pixels, described in Section 6, may be considered "sharing" of personal information under the California Consumer Privacy Act, and, depending on the jurisdiction, could also be considered a broader form of "sale" under certain other state laws, even though we receive no money in return. You have the right to opt out of this activity at any time. See Section 12 for how to exercise this right, including through Global Privacy Control.

We do not sell or share the personal information of consumers we know to be under 16 years of age.

9. Email Marketing

If you sign up for our email list, create an account, or make a purchase, we may send you marketing emails about products, promotions, and news, consistent with the preferences you've provided and applicable law. Every marketing email includes a clear unsubscribe mechanism, and we process unsubscribe requests promptly. You may also update your email preferences by contacting us at info@ziatile.com.

Recipients in Canada. If you are located in Canada, our marketing emails are sent consistent with Canada's Anti-Spam Legislation (CASL), including obtaining consent (express or implied, as permitted by law), identifying our business, and providing a functioning unsubscribe mechanism honored within the time required by law.

10. Text Messaging (SMS)

If you provide us with your mobile phone number and opt in, we may send you recurring marketing text messages (SMS/MMS) about products, promotions, order-related updates, and news. We obtain any express consent required under applicable law before enrolling you in text-message marketing. Consent to receive marketing text messages is not a condition of any purchase. Message frequency varies, and message and data rates may apply. You can opt out of marketing text messages at any time by replying "STOP" to any message, or by using the method described in the applicable message; you may reply "HELP" for assistance. We will honor opt-out requests as required by applicable law. Your mobile carrier is not liable for delayed or undelivered messages.

11. The Trade Program; Notice of Financial Incentive

Zia Tile offers a Trade Program for interior designers, architects, contractors, and other qualifying trade professionals, which provides exclusive trade pricing and other benefits. You can learn more or apply on our Trade Program page.

Notice of Financial Incentive. Because participation in the Trade Program involves providing us with business and professional information in exchange for a pricing benefit, California law treats this as a "financial incentive" program, and we are providing the following notice:

  • Summary. Trade Program members receive discounted, trade-exclusive pricing on qualifying purchases.
  • Personal Information Involved. To enroll and maintain eligibility, we collect your name, business name and address, business contact information, and resale certificate or applicable trade license/credential information, and we use your order history to verify continued eligibility and administer program benefits.
  • How to Opt In. You may apply to join the Trade Program through our Trade Program page; enrollment requires providing the business and eligibility information described above and, where applicable, agreeing to a separate Trade Program Agreement.
  • How to Withdraw. You may withdraw from the Trade Program at any time by contacting trade@ziatile.com. If you withdraw, you will no longer receive trade-exclusive pricing on future orders, but this will not affect orders already placed.
  • Value of the Incentive. We have made a good-faith, reasonable determination that the value of the trade-exclusive pricing we provide is reasonably related to the value of the business and eligibility information we collect in connection with the Trade Program, based on the reduced marketing, customer-acquisition, and account-verification costs we avoid by receiving this information directly from Trade Program members rather than through third-party channels. (Cal. Code Regs. tit. 11, §§ 7016, 999.337.)

Participation in the Trade Program is entirely optional, and declining to participate (or withdrawing later) will not affect your ability to use the Site or purchase products at standard retail pricing.

12. Your Privacy Rights

Depending on where you live, you may have certain rights regarding your personal information. This section describes those rights and how to exercise them. We do not discriminate against you for exercising any privacy right—we will not deny you goods or services, charge different prices, or provide a different level of quality solely because you exercised a privacy right, except as permitted by law in connection with the Trade Program financial incentive described in Section 11.

12.1 Your U.S. State Rights

The specific privacy rights available to you, and any applicable exceptions, depend on the laws of the state or territory where you live. Depending on your state of residency, you may have some or all of the following rights:

  • The right to know and access what personal information we collect, use, disclose, sell, and share about you, and to receive a copy of the specific pieces of personal information we hold about you;
  • The right to request deletion of personal information we have collected from you or about you, subject to certain exceptions;
  • The right to request correction of inaccurate personal information;
  • The right to obtain a portable copy of the personal information you provided to us;
  • The right to opt out of the sale or sharing of your personal information, targeted (cross-context behavioral) advertising, and certain kinds of profiling;
  • The right to limit the use and disclosure of sensitive information beyond what is necessary to provide the Services (we do not knowingly use sensitive information for any purpose that would trigger this right);
  • The right to receive notice of financial incentives we offer (see Section 11); and
  • The right to appeal our decision not to act on a request, as described in Section 12.4.

We do not currently use automated decision-making technology to make "significant decisions" about California consumers as defined under CCPA regulations effective January 1, 2026. If this changes, we will update this Privacy Policy and provide the required pre-use notice and opt-out rights.

12.2 How to Exercise Your Rights

You may submit a request to exercise your privacy rights by emailing us at info@ziatile.com.

We will need to verify your identity before responding to certain requests, which may require you to provide additional information. We will respond to verified requests within the time required by applicable law (generally 45 days, extendable once by an additional 45 days with notice to you).

Authorized Agents. You may designate an authorized agent to submit a request on your behalf. We may require the agent to provide proof of authorization and may still require you to verify your own identity directly with us.

Appeals. If we decline to act on your request, you may appeal by emailing info@ziatile.com with the subject line "Privacy Appeal." We will respond to your appeal within the time required by applicable law and explain our reasoning in writing.

12.3 Global Privacy Control and Other Opt-Out Preference Signals

Our Site is configured to detect and honor the Global Privacy Control (GPC) and other recognized universal opt-out preference signals as a valid request to opt out of the sale and sharing of personal information and targeted advertising, to the extent required by applicable law. If your browser or browser extension sends such a signal, we will apply it to the browser and device you're using, and, if you are logged into an account, to your account. Where our Site indicates that your opt-out preference signal has been honored, that confirms we have processed it as an opt-out request.

12.4 Minors

We do not sell or share the personal information of consumers we know to be under 16 years of age without affirmative authorization (opt-in consent from the minor if 13–15, or from a parent/guardian if under 13).

13. International Visitors

While Zia Tile is based in the United States and primarily serves U.S. customers, we ship internationally upon request, and this section addresses additional rights that may apply to visitors located outside the United States.

13.1 European Economic Area and United Kingdom

If you are located in the EEA, UK, or Switzerland, and to the extent the EU General Data Protection Regulation (GDPR), UK GDPR, or Swiss data protection law applies to our processing of your personal data, you have the right to:

  • Access the personal data we hold about you;
  • Request rectification or erasure of your personal data;
  • Restrict or object to certain processing, including for direct marketing;
  • Request portability of personal data you provided to us; and
  • Lodge a complaint with your local data protection authority.

We process personal data on the following legal bases, as applicable: performance of a contract (to fulfill your orders), consent (for marketing and non-essential cookies), legitimate interests (for fraud prevention, Site security, and analytics), and compliance with legal obligations. Where we transfer personal data outside the EEA or UK, we do so using appropriate safeguards, such as the European Commission's Standard Contractual Clauses or the UK's International Data Transfer Addendum.

13.2 Canada

If you are located in Canada, Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) (and applicable provincial equivalents) gives you the right to access and challenge the accuracy of your personal information, and to withdraw consent, subject to legal or contractual restrictions. Our marketing emails to Canadian recipients also comply with Canada's Anti-Spam Legislation, as described in Section 9.

13.3 Other Jurisdictions

If you are located in a jurisdiction with a data protection law not specifically addressed above (such as Brazil's LGPD, or other countries' privacy laws), we will honor requests consistent with your applicable local law to the extent required. Please contact us using the details in Section 21 to submit a request.

13.4 Where We Process Your Information

Zia Tile is based in the United States, and the personal information we collect is processed and stored in the United States and in other countries where our service providers operate. If you access our Site or Services from outside the United States, you understand that your personal information will be transferred to, and processed and stored in, the United States, where data protection laws may differ from, and may not provide the same level of protection as, the laws of your country. Where we transfer personal data from the EEA, UK, or Switzerland, we do so using the appropriate safeguards described in Section 13.1. By using our Site and Services or otherwise providing your personal information to us, you acknowledge this transfer, processing, and storage.

14. Children's Privacy

Our Services are not directed to children, and we do not knowingly collect personal information from children under 13 (or the relevant age of digital consent in your jurisdiction) without verifiable parental consent, consistent with the U.S. Children's Online Privacy Protection Act (COPPA) and similar laws. If we learn that we have collected personal information from a child without the required consent, we will delete that information promptly. If you believe a child has provided us with personal information, please contact us at info@ziatile.com.

15. Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including to provide the Services, comply with our legal and tax obligations (such as retaining order and payment records for the period required by applicable tax law), resolve disputes, and enforce our agreements. When personal information is no longer needed for these purposes, we will securely delete or anonymize it, or, if that is not immediately possible, securely isolate it from further use until deletion is possible.

16. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, disclosure, alteration, or destruction. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

17. Third-Party Links and Services

Our Site may contain links to third-party websites, plug-ins, or services (including social media platforms). We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies before providing any personal information to them.

18. Do Not Track Disclosures

Some browsers offer a "Do Not Track" (DNT) signal. Because there is no accepted industry standard for recognizing and responding to DNT signals, our Site does not currently respond to DNT signals. We do, however, recognize and honor Global Privacy Control and other opt-out preference signals as described in Section 12.3.

19. California "Shine the Light" Law

California Civil Code § 1798.83 permits California residents to request certain information, once per calendar year and free of charge, regarding our disclosure (if any) of personal information to third parties for their own direct marketing purposes in the preceding calendar year. We do not disclose personal information to third parties for their own direct marketing purposes. If you have questions, contact us using the details in Section 21.

20. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will update the "Effective Date" above and, where required by law, provide additional notice (such as a banner on our Site or an email) before the changes take effect. We encourage you to review this Privacy Policy periodically.
